People v. Logan M
Description: Client charged with felony theft with one prior strike and three prison priors for total exposure of 9 years prison with 15% eligible good time credits.
Outcome: Misdemeanor probation with 27 actual days jail credit and 32 additional days to serve on the Adult Offender Work Program.
United States v. Cole
Description: Client was charged with real estate fraud. The United States Sentencing Guidelines provide for sentencing range of 27 to 33 months federal prison.
Outcome: Client was sentenced to five months federal prison.
Fresno RV, Inc. dba RV Outlet; et. al v. Paul Evert’s RV Country, et. al
Description: Judge Jeffrey Y. Hamilton conducted the court trial. He ruled that Paul Evert, Charles Curtis, and Aaron Lyon conspired to put my clients out of business by falsely alleging my clients committed fraud.
Outcome: Judge Jeffrey Y. Hamilton awarded $500,000 in compensatory damages and $4,058,000 in punitive damages in favor of my clients.
People v. McFarland
Description: Client charged with strike offense of residential burglary with resident present.
Outcome: Our motion to dismiss on Federal and State Constitutional ground was granted. Case was dismissed in its entirety.
People v. Megan Martzen
Description: Ms. Martzen was charged with second degree murder and child abuse homicide. The minimum sentence, if convicted of the charges, was 25 years to life in prison.
Outcome: Jury trial ended in a hung jury, with the jury voting 10-2 and 8-4 not guilty on Counts 1 and 2, case settled for probation and community service.
People v. Dean
Description: Client was charged with ten felony counts of illegal possession of firearms and one misdemeanor count of illegal possession of firearms.
Outcome: The court granted the motion to reduce all felonies to misdemeanors and the client was permitted to serve his jail time as community service and retain his professional licenses, which would have been revoked with The conviction of even a single felony count.
People v. Dana Ewell and Joel Radovcich
Description: I was one of the two prosecutors on this case in which Dana Ewell hired his college buddy to murder his mother, father and sister for the $8,000,000 estate. The case received national attention and was the subject of four national criminal law programs, including Forensic Files and Solved.
Outcome: Life in prison without the possibility of parole for both defendants.
